The University (according to the The Operating Agreement between the University of Southern Mississippi and The University of Southern Mississippi Foundation) agrees to:
"Provide offices and utilities [to the Foundation] adequate for the performance of the services required hereunder. .... Provide technology support services as well as online access to such University files as are relevant to the business and purpose of the Foundation." (Operating Agreement, para. 3C and D)
"... donor and fund information maintained in furtherance of the Foundation’s fundraising activities is recognized to be the property of the Foundation and as such is confidential whether in paper or electronic format." (Operating Agreement, para. 6)
